Terms, Conditions &
Participation Waiver

Operated jointly by Passport 2 Pickleball, LLC & Chapter One Travel Services, LLC — An Arizona Limited Liability Entity Structure

Important Notice to Participants: Please read this Agreement carefully. By submitting a deposit, registration form, administrative fee, or payment for a Passport 2 Pickleball retreat, you acknowledge, agree to, and accept all terms, conditions, waivers, releases, and policies detailed herein on behalf of yourself and all travelers/participants included in your booking.

1

Scope of Services & Entity Relationship

Passport 2 Pickleball, LLC operates and hosts athletic pickleball retreats in coordination with Chapter One Travel Services, LLC, which acts as the primary travel booking agent and logistics organizer. Both entities (collectively, "Company," "we," "our," or "us") act solely as booking agents and facilitators for disclosed third-party suppliers of travel and event services.

These include airlines, rail providers, hotels, resorts, cruise lines, car rental agencies, court facility operators, catering providers, instructors, and excursion operators ("Travel Service Providers"). We do not own, operate, or directly control these independent suppliers. Your primary accommodation and travel service contracts remain with the respective Travel Service Providers, and neither Passport 2 Pickleball, LLC nor Chapter One Travel Services, LLC is liable for their acts, omissions, errors, breaches, or representations. We make no guarantees regarding third-party services or outcomes.

2

Comprehensive Assumption of Risk & Pickleball Activity Liability Release

Pickleball and group travel involve physical exertion, sports-related strain, outdoor environmental factors, and inherently unpredictable physical and travel risks. By registering for a retreat, you explicitly acknowledge and agree that:

Assumption of Sports & Travel Risks: Participation in pickleball clinics, open play, tournament sessions, physical conditioning, water activities, excursions, and group travel involves inherent risks — including sprains, fractures, muscle tears, heat exhaustion, cardiac events, slips, trips, falls, collisions with court surfaces or other players, equipment failure, bodily injury, illness, permanent disability, or death. Travel also carries risks of political instability, weather disruptions, and health events. You voluntarily assume all risks, known and unknown, associated with your participation.

Complete Waiver of Injury & Loss Liability: Passport 2 Pickleball, LLC, Chapter One Travel Services, LLC, their owners, members, managers, officers, employees, instructors, guides, agents, and independent contractors SHALL NOT BE LIABLE for any personal injury, bodily injury, medical emergency, property loss, or damage occurring before, during, or after any retreat activity, court session, clinic, or transit. You release and hold harmless both entities from any liability arising from these risks.

Medical Authorization & Health: You certify that you are in good physical health and have no medical condition that would prevent safe participation in athletic activities. You are responsible for consulting a physician prior to travel. In the event of an injury or medical emergency, you authorize Passport 2 Pickleball, LLC and Chapter One Travel Services, LLC to seek emergency medical treatment on your behalf at your sole expense.

3

Participant Conduct, Code of Sportsmanship & Safety Rules

To maintain a safe, respectful, and enjoyment-focused environment for all guests:

Court Safety & Sportsmanship: Participants must adhere to court safety guidelines, wear appropriate court footwear, follow instructions from coaching staff, and maintain high standards of sportsmanship.

Alcohol & Substance Policy: Consuming alcohol or controlled substances prior to or during physical play is strictly prohibited. Intoxicated participants will be barred from court facilities without refund.

Right to Expel or Withdraw Service: Passport 2 Pickleball, LLC and Chapter One Travel Services, LLC reserve the absolute right to terminate participation, withdraw services, or remove any participant from the retreat at their own expense if their behavior is deemed disruptive, abusive, profane, unsafe, harassing, or disrespectful to staff, facilities, or fellow participants. In such cases, no refunds will be issued.

4

Administrative Fees, Deposits & Payment Terms

All pricing is structured around fixed group resort commitments and vendor contracts:

The administrative fee of $100 per person is separate from the travel package and is non-refundable, and non-transferable under any circumstances.

Retreat Deposits & Balance Schedule: A deposit is required to confirm travel arrangements. All retreat payments and deposits become 100% non-refundable ninety-five (95) days prior to the retreat start date.

Final Payment: Due no later than 95 days prior to departure unless explicitly stated otherwise in writing. Bookings made within 95 days of departure require payment in full at the time of booking and are immediately non-refundable.

Late Payments & Price Increases: Failure to remit balances by the 95-day due date may result in automatic cancellation and forfeiture of prior payments. Quotes in foreign currencies are subject to exchange fluctuations. Prices may increase prior to full payment due to government taxes or supplier surcharges.

5

Cancellations, Modifications & Refunds

Client Cancellations: Cancellations requested within 95 days prior to departure are 100% non-refundable. For eligible cancellations requested prior to 95 days before departure, refunds (if applicable) are governed strictly by vendor/supplier policies and are subject to the non-refundable $100 per person administrative fee.

Supplier & Itinerary Changes: Schedules, tournament formats, guest instructors, and court schedules are subject to change due to weather, facility constraints, or instructor availability. Equivalent substitutions will be made where feasible, and changes do not entitle clients to refunds. We are not responsible for changes, delays, or cancellations initiated by third-party suppliers.

6

Mandatory Travel & Medical Insurance

Travel insurance is mandatory for all retreat participants and is included in the package price. Coverage includes trip cancellation, medical evacuation, emergency treatment, sports injuries, lost baggage, and trip interruption.

Neither entity administers insurance policies, and you agree to hold both Passport 2 Pickleball, LLC and Chapter One Travel Services, LLC harmless for any claim denials by insurance underwriters.

7

Travel Documents & Logistics Responsibility

Document Compliance: Participants are individually responsible for securing valid passports (valid at least 6 months beyond the retreat end date), visas, entry declarations, and health requirements. Entry denial or fines due to improper documentation are the client's sole responsibility.

Transit Logistics: You are responsible for reconfirming flights 24–72 hours prior to departure, arriving at airports on time (2 hours domestic / 3 hours international), and managing baggage limits or airport fees. Neither entity is liable for missed flights or issues resulting from client delays.

Reservation Rules: You agree not to engage in prohibited airline ticketing practices (e.g., hidden-city or throwaway ticketing). You agree to indemnify us for any losses resulting from such violations.

8

Weather, Playing Conditions & Force Majeure

Pickleball is frequently played outdoors. While efforts will be made to adjust schedules or utilize covered courts during inclement weather (e.g., rain, wind, extreme heat), neither Passport 2 Pickleball, LLC nor Chapter One Travel Services, LLC is liable for weather disruptions, canceled play, or court closures.

Furthermore, neither entity shall be held liable for failure to perform obligations, delays, or cancellations caused by events of Force Majeure, including natural disasters, extreme weather, pandemics, acts of government, civil unrest, strikes, terrorism, or supplier closures.

9

Media Release & Likeness Consent

By attending a Passport 2 Pickleball retreat, you grant Passport 2 Pickleball, LLC and Chapter One Travel Services, LLC permission to photograph, audio record, and video record clinics, matches, and group activities.

You grant a perpetual, royalty-free, worldwide license to use your image, voice, and likeness in promotional materials, websites, social media, and marketing collateral without further compensation or prior approval.

10

Credit Card Usage, Chargebacks & Disputes

If a credit card is used for booking, you agree not to initiate chargebacks or payment disputes against Passport 2 Pickleball, LLC or Chapter One Travel Services, LLC for non-refundable fees, administrative fees, weather disruptions, or supplier non-performance.

If a credit card is declined or an improper chargeback is initiated, you agree to pay all outstanding amounts, collection costs, legal fees, and interest calculated at 1.5% per month (18% per annum).

11

Dispute Resolution, Governing Law & Jurisdiction

This Agreement shall be governed by and construed under the laws of the State of Arizona. Any dispute, claim, or controversy arising out of or relating to this Agreement or retreat participation shall first be submitted to good-faith mediation.

If unresolved, disputes shall be settled through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. All proceedings must take place exclusively in Pinal County, Arizona, and participants consent to personal jurisdiction therein.

12

Indemnification

You agree to defend, indemnify, and hold harmless Passport 2 Pickleball, LLC, Chapter One Travel Services, LLC, their members, managers, officers, and affiliates against any and all claims, liabilities, damages, losses, costs, or legal fees resulting from your participation in the retreat, court misconduct, rule violations, payment defaults, or damage caused to resort or pickleball facilities.

13
